Terms of Service

These terms govern your use of Wikexa. They describe what you can expect from us, what we expect from you, and who owns what.

What you can expect from us

We provide the Wikexa service — the API, website, documentation and supporting software at wikexa.com — and work to keep it accurate, fast and available. We develop and improve it continuously, which means features, response shapes and limits can change.

We provide the service free of charge at ordinary volumes. We are not obliged to continue doing so, and we may add, modify, suspend or discontinue any part of it, with or without notice.

What we expect from you

Use the service reasonably and lawfully. In particular, you may not:

  • Extract in bulk. Systematically download, scrape, mirror, crawl or accumulate output beyond what your own application needs to serve its own users.
  • Rebuild or resell it. Re-host or proxy the API as your own, resell access, or use output to build a competing knowledge API, index or database product.
  • Train models on it. Use output to train, fine-tune, distil or benchmark machine learning models. That requires a separate licence, which we grant — ask.
  • Reverse engineer the service, or attempt to reconstruct the index, ranking model or pipeline from its behaviour.
  • Evade limits. Circumvent rate limits or access controls, including by spreading requests across addresses, accounts or identities.
  • Misrepresent. Remove or obscure attribution we supply, or imply endorsement by us or by any source project.
  • Interfere. Disrupt the service, or the upstream sources it depends on.

We may investigate suspected breaches and respond by limiting, suspending or ending your access.

Permission to use the service

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable licence to use the service and its output in your own applications, including commercially, subject to these terms. This licence is to use the service; it transfers nothing to you.

Our rights

Wikexa and everything we built to deliver it remain ours. That includes, without limitation:

  • the ingest, extraction and normalisation pipeline, and the record schemas it produces;
  • the search index and ranking model, including all weighting, scoring and tuning;
  • the alias and entity resolution indexes;
  • the compilation — the selection, coordination, structure and arrangement of the whole — and any database rights subsisting in it;
  • derived metadata: popularity signals, relevance scores, snippets, summaries as structured, and cross-references;
  • the API design, response schemas, software, and the Wikexa name, wordmark and design.

These are protected by copyright, database, trade secret and other laws. Using the service grants you no rights in them, and all rights not expressly granted here are reserved.

Content in the service

Material the service processes originates with third parties, each source under its own licence. Those sources currently include Wikimedia project content (CC BY-SA 4.0) and Wikidata (CC0), and further sources are added over time. We do not own that source material and make no proprietary claim to it.

If you republish material obtained through the service, meeting its licence conditions is your responsibility. Every response carries the source_url and license for the material it contains, so you have what you need to comply. You indemnify us for any failure to do so.

None of this affects our rights above, which subsist in our own work rather than in the source material.

Fair use, monitoring and commercial volumes

Access is free at fair-use volumes. We monitor use of the service to operate and protect it, to plan capacity, and to understand how it is being used commercially — see Privacy.

We may rate-limit, throttle or block traffic that in our reasonable judgement exceeds fair use or breaches these terms, and we may require a written agreement for continued access at commercial volumes. If you are operating at that scale, talk to us — we would rather agree terms than restrict you.

Accuracy

Output is machine-processed from third-party reference sources. It may be incomplete, out of date or wrong, and our processing may introduce errors of its own. Do not rely on it for medical, legal, financial or safety-critical decisions. Verify anything consequential against the linked source.

Warranty disclaimer

THE SERVICE AND ITS OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data. Our total aggregate liability is limited to the greater of amounts you paid us in the preceding twelve months or USD 100.

Indemnity

You will indemnify and hold us harmless against claims, damages and costs arising from your use of the service, products you build on its output, your breach of these terms, or your failure to meet third-party licence obligations.

Suspension and termination

You may stop using the service at any time. We may suspend or end your access for breach or suspected breach, or to protect the service. Our rights, your restrictions, the disclaimers, the liability limit and the indemnity survive termination.

Governing law

These terms are governed by the laws of the State of Utah, USA, excluding conflict-of-law rules. The state and federal courts in Utah have exclusive jurisdiction and you consent to that venue.

About these terms

These terms are the entire agreement between us on their subject and replace any prior understanding. If a provision is unenforceable, the remainder stands. Not enforcing a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.

We may update these terms. Material changes will be reflected in the effective date above, and continued use after that date constitutes acceptance.
